Refund Policy

At HVG MACHINERY, we aim to provide clear and transparent information about our tractors, construction machinery and other used equipment.

Because our machinery is generally sold as individual used items, our Refund Policy is subject to the specific sales agreement, applicable law and the circumstances of each transaction.

2. Used Machinery

The machinery offered by HVG MACHINERY is generally used equipment.

Customers are encouraged to inspect the machinery before purchasing or, where appropriate, arrange an independent inspection.

By purchasing a machine, the customer acknowledges that used machinery may have signs of previous use, wear and tear, cosmetic imperfections and other characteristics associated with its age and previous operation.

3. Cancellation Before Payment

If a customer has made an enquiry or received a quotation but has not yet made any payment, the customer may cancel the purchase request without a refund being applicable.

A quotation or enquiry does not automatically create a binding purchase agreement unless expressly confirmed by HVG MACHINERY.

4. Payments and Deposits

Where a deposit or advance payment has been agreed, the terms relating to that payment will be communicated to the customer before payment is made.

A deposit may be non-refundable where:

  • The customer cancels the purchase after the machinery has been specifically reserved for them;

  • HVG MACHINERY has incurred costs specifically related to the transaction;

  • Transportation or other services have already been arranged;

  • The customer fails to complete the purchase in accordance with the agreed terms;

unless applicable mandatory law provides otherwise or HVG MACHINERY agrees otherwise in writing.

5. Full Payment

Machinery will only be released after the full purchase price and any agreed additional costs have been received and are clearly visible and available in the HVG MACHINERY bank account.

A bank transfer receipt, payment confirmation, screenshot or other proof of payment does not constitute confirmation that the funds have been received.

6. Cancellation After Full Payment

If a customer wishes to cancel a transaction after full payment has been received, the customer must contact HVG MACHINERY as soon as possible.

Whether a refund is available will depend on:

  • The terms of the applicable sales agreement;

  • Whether the machinery has already been released;

  • Whether transportation has already been arranged;

  • Whether the machinery has already been collected or delivered;

  • Any costs already incurred by HVG MACHINERY;

  • The customer's legal status as a consumer or business;

  • Applicable mandatory law.

HVG MACHINERY will assess each request individually.

7. Transportation Costs

Transportation costs are generally separate from the purchase price unless expressly included in the sales agreement.

If transportation has already been arranged or costs have already been incurred on behalf of the customer, such costs may be non-refundable to the extent permitted by applicable law.

8. Refunds Due to HVG MACHINERY

If HVG MACHINERY agrees to provide a refund, or if a refund is required under applicable law, the refund will normally be made using the original payment method where reasonably possible.

HVG MACHINERY may request the necessary banking or payment information to process the refund securely.

Refund processing times may depend on the customer's bank or payment provider.

9. Refunds Due to Legal Rights

Nothing in this Refund Policy is intended to exclude or restrict any statutory rights that the customer may have under applicable law.

Where mandatory consumer protection or other legal provisions provide a right to cancellation, refund, repair, replacement, price reduction or another remedy, those rights will continue to apply.

The rights available to a customer may differ depending on whether the customer is purchasing as a private consumer or as a business.

10. Machinery Condition and Refund Requests

A refund request based solely on normal characteristics of used machinery, including ordinary wear and tear or minor cosmetic imperfections, may not be accepted where these characteristics were reasonably apparent or disclosed before purchase.

If a customer believes that a machine does not conform to the agreed terms or has another significant issue, the customer should contact HVG MACHINERY as soon as reasonably possible and provide relevant details and supporting evidence.

Depending on the circumstances and applicable law, HVG MACHINERY may request photographs, videos, inspection reports or other information concerning the issue.

11. Incorrect or Damaged Delivery

If machinery is delivered damaged or materially different from what was agreed, the customer should contact HVG MACHINERY promptly.

Where appropriate, the customer may be asked to provide:

  • Photographs of the machinery;

  • Photographs of any visible damage;

  • Transport or delivery documentation;

  • A description of the issue;

  • Other relevant evidence.

The matter will then be assessed in accordance with the sales agreement and applicable law.

12. Refunds Are Not Automatic

Submitting a refund request does not automatically create an entitlement to a refund.

Each request will be reviewed according to the applicable sales agreement, the circumstances of the transaction and mandatory applicable law.

Where a refund is approved, HVG MACHINERY will communicate the applicable refund amount and procedure to the customer.
